Oskaloosa Indian football at Pella Christian tonight

It’s opening night for high school football.  The Oskaloosa Indians kick off their season tonight at Pella Christian.  Osky Coach Jake Jenkins says Pella Christian may be a 1A school and Oskaloosa 3A, there are about the same number of players on each team.  “It’s a very, very good matchup.  They have athletes, they have a lot of athletes.  They have coaches, they have a lot of coaches. They have community support, they have a lot of community support.  You look at the Indians, we have the exact same thing: coaches coaching their tails off, kids playing really hard, we have some athletes and we have great community support.   I’m just excited that two football towns, two very good are coming together to strap it up.  I think it’s going to be very good Iowa high school football and I look forward to it a lot.”

August 23rd: On this day

On this day in 1969 Johnny Cash was at #1 on the Billboard country singles chart with “A Boy Named Sue”. The song tells the tale of a young man’s quest for revenge on a father who abandoned him at 3 years of age and whose only contribution to his entire life was naming him Sue, commonly a feminine name, which results in the young man suffering from ridicule and harassment by everyone he meets in his travels. Also on this day Chet Atkins appeared as the special guest on this week’s Johnny Cash ABC television music variety show.

Mollie Tibbetts’ accused murderer has bail set at $5 million cash only

The man accused of murdering Mollie Tibbetts appeared in court Wednesday afternoon.  Twenty-four-year-old Cristhian Rivera is charged with first degree murder in Tibbetts’ death.  In a hearing in Powesheik County, Assistant Attorney General Scott Brown asked that Rivera’s bail be set high.  “We think it is appropriate given the severity of the charge, his immigration status, at least as it has been described to me, and the fact that what he is accused of is obviously a heinous crime, and certainly the safety of the community should be foremost in the Court’s mind whenever setting bond.  So that’s what we have requested, that bond be set at $5 million cash only.”

Magistrate Judge Diane Crookham-Johnson agreed and set a preliminary hearing for August 31 at 2pm.  Also at Wednesday’s hearing, defense attorney Allan Richards argued against expanded media coverage of the trial.  “In this particular case, the coverage that’s out there is leaning all one way.  In fact, the government has weighed in at the highest levels of predisposition that this young man, Cristhian, is guilty.”  During Wednesday’s court hearing, Rivera was stoic and said little when spoken to.  He had an interpreter, as did his attorney.

Meanwhile, the manager of a dairy farm where Rivera worked says he worked there for four years under a fake name.  Dane Lang, manager of Yarrabee Farms in Brooklyn, said that Cristhian Bahena Rivera presented an out-of-state government-issued photo identification and a matching social security card when he was hired in 2014. Lang says, “our employee is not who he said he was.”  Lang said the farm ran the information through the Social Security Administration’s employment verification system and it checked out. He said the farm didn’t use the E-Verify system as it asserted in a statement Tuesday night, saying an employee was mistaken.  Lang also says he has received dozens of threatening phone messages and other contacts in the last 24 hours, including death threats.  One person threatened to kill his dog and another said he would burn down his farm buildings. Lang says, “This is a really scary situation.”

Also, the family of Mollie Tibbetts released a statement Wednesday that notes their grief but also thanks “all of those from around the world who have sent their thoughts and prayers for our girl.”  The statement adds, “We know that many of you will join us as we continue to carry Mollie in our hearts forever.”  Tibbetts’ body was found Tuesday and 24-year-old Cristhian Bahena Rivera has been charged with first-degree murder in her death. Tibbetts was last seen July 18.

 

Toddlers survive for two days after car crash kills mother in Arkansas

A pair of toddlers — ages 3 and 1 — were found alone near a highway in Arkansas roughly two days after surviving a single-car crash killing their mother. The Ouachita County Sheriff’s Department said it has identified a 3-year-old child they found wandering near a highway in Camden, which is about 100 miles southwest of Little Rock, reports CBS affiliate KTHV.  After returning to the scene where the toddler was found, police discovered a car laying on its side in a ravine not visible from the highway, said KTHV. Inside the car, they found the 1-year-old fastened in a car seat.  The driver of the car, the toddlers’ mother, was reportedly ejected from the vehicle and died.

The one-year-old was taken to Arkansas Children’s Hospital and treated for non-life-threatening conditions including possible dehydration, reports ABC affiliate KATV in Little Rock.    According to NBC’s KARK, the children’s grandparents are in the process of taking custody of the toddlers.  Detective Nathan Greeley of the Ouachita County Sheriff’s Office told KATV said finding both toddlers alive after roughly two days was especially notable because they survived summer heat and humidity. “Today is anything but short of a miracle,” he said

On this day in 1982 Willie Nelson was at #1 on the country album chart with Always on My Mind, which became the Billboard #1 country album of the year. The album spent 22 weeks at the top of the charts and stayed for a total of 253 weeks on the Billboard Top Country Albums charts. The title track was originally recorded by Brenda Lee in 1972 and has since been recorded by dozens of performers including Elvis Presley in 1972 and John Wesley Ryles in 1979.

Cristhian Rivera charged with first-degree murder

It has been learned that Cristhian Rivera had worked at Yarrabee Farms for the last four years and was an employee in good standing. The company said it was shocked to hear that Rivera had been charged in the death of 20-year-old Mollie Tibbetts.  The farm is owned by Craig Lang, who previously served as president of the Iowa Farm Bureau and president of the Iowa Board of Regents, which governs the state’s public universities. In June, he lost a close GOP primary in the race for state agriculture secretary.

And Immigration and Customs Enforcement released a statement Tuesday stating that it had “lodged a detainer” with the Poweshiek County sheriff’s office to hold Rivera after he was charged with first-degree murder.

 

Charges filed for the murder of Mollie Tibbetts

The search for Mollie Tibbets is over.  Iowa law enforcement has charged an illegal immigrant with first degree murder in the 20-year-old Brooklyn woman’s death.  Special agent Rick Rahn of the Iowa Division of Criminal Apprehension spoke to reporters Tuesday afternoon in Montezuma.

“An affidavit named Cristhian Bahena Rivera, age 24, who resides in rural Powesheik County and he has been charged with murder in the first degree.  A body was discovered early this morning in a farm field southeast of Brooklyn, Iowa.  The identity has not been confirmed, however, we believe it to be the body of Mollie Tibbetts.”

That corn field was about 12 miles southeast of Brooklyn, where Tibbets was last seen July 18 when she went for a run.  Rahn says one of hundreds of tips that were called in after Mollie’s disappearance paid off.

“During our neighborhood canvas, we came across an individual that had security cameras.  We took those cameras; he was kind enough to give us the footage from it.  And through that, we were able to identify a vehicle that we believe belonged to Mr. Rivera. It was a black Malibu and from that we were able to track his pattern and the routes in which he took.  We were also able find Mollie running on this video and we were able to determine that he was one of the last ones to have seen Mollie running, based on the video that we were able to seize from the general public.”

An affidavit attached to the criminal complaint against Rivera alleged that he admitted to investigators he got out of his car and started running alongside Tibbetts.  She grabbed her phone and said she was going to call the police. The affidavit says Rivera panicked and then said he blacked out. Rivera next remembers seeing her earphones on his lap, and taking her bloody body out of the trunk of his car.  An autopsy on Mollie’s body will be held Wednesday in Ankeny; it could take four to six weeks to get the results. Rahn says Rivera has been living in Powesheik County between four and seven years and that he is not a legal US resident.  Rivera is being held in custody in the Poweshiek County Jail; no word when he’ll appear in court.
