BAHENA RIVERA TO APPEAR IN COURT

Bahena Rivera to appear in court

A hearing will be held in Poweshiek County Court Wednesday morning (11/13) to determine what evidence can be used in Cristhian Bahena Rivera’s murder trial.  He’s accused of killing 20-year-old Mollie Tibbetts last summer in Brooklyn.  One of the law enforcement officers involved in the case did not fully read Rivera his Miranda rights, so Rivera’s attorneys want part of his interview with police to not be used as evidence.  State prosecutors understand Rivera will testify through a written affidavit.  They contend that since the affidavit is the same as testimony, they should have the right to cross-examine Rivera.  Rivera’s murder trial is scheduled for February in Sioux City.
